Article 1: Presentation of Bauges Parapente and General Terms and Conditions of Sale (GTC)

These General Terms and Conditions of Sale (GTC) are written by the company Bauges Parapente, specialized in the sale of paragliding trainings and tandem flights for educational purposes. It is represented by Mr. Thomas Pierre BATARD, residing at ZA La Madeleine 73340, registered under SIRET number 90094937100018. The purpose of these GTC is to establish the terms of the contract between Bauges Parapente and its customers regarding reservation procedures, applicable rates, accepted payment methods, the organization of the activity, as well as cancellation and refund conditions.

We invite you to read these GTC before making any reservation. By making a reservation with Bauges Parapente through the website bauges-parapente.com, you acknowledge having read and accepted the GTC. These GTC prevail over any other document, unless there is a prior written agreement from us.

We thank you for your trust and are at your disposal for any questions regarding the GTC or our services.

Article 2: Rates

The rates indicated on the website www.bauges-parapente.com are in euros, per person, and are tax-free. These are the rates that are used for payment at the time of service.

Article 3: Bookings

Bookings for tandem flights are made on the website www.bauges-parapente.com or by phone at +33 (0)7 48 90 40 50. We will need the names of the people who wish to fly, their weight, and the type of flight they wish to book. You will also be asked for a phone number where we can reach you.

For paragliding trainings, reservations are made on the website www.bauges-parapente.com, through the Book and Glide booking platform. Your spot is reserved after completing your personal information and validating the online payment for the deposit

Article 4: Means of Payment

For tandem flights, we accept payment in cash in euros, by credit card, and by check issued from a French bank. An identity card may be requested for any payment by check. The payment is made after the flight if your flight was booked by phone, in order to adjust the rate if the flight actually performed differs from the one initially reserved due to weather conditions. If your reservation was made online and pre-paid by credit card, the price difference will be refunded if ever the flight that was paid for ends up not being the one performed due to weather conditions. In this case, the customer will be informed at the end of the flight, and we will proceed with the refund by credit card within a maximum period of 7 days.

For paragliding trainings, the deposit can be paid online by credit card to reserve your spot right away. If you wish to send a bank transfer or a check issued from a French bank for your desposit, we need to receive it within 7 days of your online reservation and it will only be validated upon the reception of payment. We will send you a confirmation email when that happens. Otherwise, Bauges Parapente reserves the right to cancel your reservation, without any compensation possible. The remaining portion of the price of training is to be paid at the end of it; in cash in euros, by bank transfer, or by check.

Article 5: Specific Nature Environment Responsibility

Doing sports in natural environments involve risks. Supervision by a professional does not eliminate these natural risks. The customer must respect the safety and behavior rules that arise from common sense, as well as those transmitted by the instructor. The instructor is subject to an obligation of means and not of results. He implements all available means, including renunciation, to ensure the safety of the participant, passenger, or student, who keeps an active role in the activity.

This active role applies in particular to passengers of tandem flights during takeoff and landing. As indicated on the website, it is necessary for the passenger to be equipped with suitable clothing and to be able to provide a moderate run during takeoff and landing. Bauges Parapente reserves the right to cancel the flight (without financial compensation) if the instructor deems that these conditions are not met.

Article 6: Photos/Videos and Client's Equipment for Tandem Flights

Unless the client expresses his objection or the weather conditions make it impossible, Bauges Parapente takes photos and videos during each flight. No purchase is necessary from the client. They will be free to decide whether to buy the optional photos/videos after the flight. If purchased, the photos/videos will be provided on an SD card or directly transferred to the client’s mobile phone. The photos/videos will be paid for after the flight if they were not paid in advance.

Once the client is in possession of the SD card or the photos/videos have been transferred, these files become their responsibility. Bauges Parapente does not keep copies of the photos and videos, and any loss due to misuse or loss of the card is solely the client’s responsibility.

If the photos/videos cannot be taken due to equipment malfunction or safety reasons, Bauges Parapente cannot be held responsible. In this case, only the cost of the flight will be due. If the instructor agrees, the client may also capture their own images (using their mobile phone, GoPro, etc.). However, the instructor can refuse if weather conditions do not allow to do it safely or if the equipment is not secured with a leash.

In no case will Bauges Parapente and/or the instructor be held responsible for the fall and/or loss of the client’s personal objects such as shoes, glasses, jewelry, mobile phone, camera, hearing aid, etc. This list is not exhaustive.

Article 7: Cancellation for Tandem Paragliding Flights

From the Client:

Refund conditions in case of cancellation by the client:

  • More than 7 days before your flight: no fees will be charged. You will be refunded for the amount paid, or we will offer you another date.
  • Within 7 days before the flight: 50% of the flight is due.
  • Within 72 hours before the flight: 100% of the flight is due.

Only a medical certificate with an indication against paragliding can justify a refund or a no-fee cancellation.

Make sure that you are on time at the meeting point provided the day before your flight: If you are more than 30 minutes late, your flight will be canceled, and no refund will be made.

From Bauges Parapente:

As paragliding activities are subject to weather conditions, Bauges Parapente can cancel a flight up to the last moment (crew ready to take off) to ensure the safety of its clients. The client will be offered the option to reschedule the flight for another day. If not possible, this will result in a no-fee cancellation of the flight or a total refund if it was paid in advance.

Bauges Parapente will try to inform its clients as early as possible about the uncertainty of weather conditions to avoid unnecessary travel, but cannot be held responsible for cancellations due to weather conditions. We will contact you by phone at the number you provided. Therefore, it is the responsibility of the client to ensure that the contact information given is correct and to remain reachable on the day before and the day of the flight. Bauges Parapente cannot be held responsible if the client contacted by phone did not answer and/or did not receive the message left.

Article 8: Cancellation for Trainings

From the student (Beginner and Novice trainings):

  • In case of cancellation by the student, your deposit will be retained, regardless of the timeframe, unless replaced by another participant with the prerequisites for the course.
  • Your unannounced absence at the beginning of the course commits you to pay the full price of the course.
  • Partial cancellation or early departure entitles you to no reduction or credit.

From Bauges Parapente:

  • If a training session has fewer than 3 registered students, Bauges Parapente reserves the right to cancel the session. We will contact you to suggest new dates. If we cannot agree on a later date, we will refund the entire deposit.
  • In case of bad weather expected throughout the training’s duration or other exceptional events, we may have to cancel your paragliding training. In this case, we will notify you no later than 48 hours before your course. Depending on the schedule and your availability, we will try to find a later date for your training. If no date is suitable, we will proceed with the reimbursement of the deposit.
  • In the event of bad weather during one or a few days of a training session, the non-validated days of the course will be subject to credit or refund.
  • During the training, Bauges Parapente reserves the right to put a stop to a client’s lessons due to physical or psychological incapacity that could jeopardize their safety. In this exceptional case, the refund will be calculated proportionally to the canceled days.

Article 9: Equipment for Paragliding Trainings

Bauges Parapente provides all the necessary flight equipment throughout your training.

You can use your personal equipment for any training, which will give you a 10% discount on the price of your training or flight card. It must be certified and controlled, and a control less than a year old may be requested. Bauges Parapente reserves the right to refuse equipment that does not meet these safety criteria.

In case of damage to Bauges Parapente’s equipment by a student due to non-compliance with the instructors’ instructions, Bauges Parapente reserves the right to charge the student the cost of getting it repaired by an approved workshop.

Article 10: Insurance for Tandem Flights

  • Included Insurance: This insurance includes basic coverage for Personal Accidents and Civil Liability detailed here.
  • Supplementary Insurance: It is the responsibility of the client who considers that the level of coverage is not enough in relation to the practiced activity and their personal social protection to subscribe to additional guarantees.

Article 11: Use of Gift Certificates for Tandems and Trainings

  • Validity Period: Gift certificates are valid for one (1) year from the date of payment.
  • In case of bad weather, the service will be postponed within the validity date of the gift voucher.
  • Under no circumstances can a gift voucher be refunded or extended after its expiration date. However, it can be transferred to a third party after agreement with Bauges Parapente and the reissue of the gift certificate with the new beneficiary’s name.
  • After its validity date (1 year after the purchase date), the gift certificate will be considered expired even if it was not used, and cannot be refunded or financially compensated.

For any online purchase of a gift certificate, the client has the right to withdraw within fourteen (14) days of the order since the service is not date-specific at the time of purchase. The client may withdraw by contacting Bauges Parapente by email (contact@bauges-parapente.com) or by phone: +33 (0)7 48 90 40 50. The refund will be made within 30 days following the notification of withdrawal.

Article 12: Use of “a la carte” Flight Cards

  • Flight cards are valid for one (1) year from the date of payment. Payment for the flight card is made after the first session (slope school for an external client, or first flight for a pilot that has already been at our school).
  • Flight cards cannot be refunded or extended after their expiration date, except upon presentation of a medical certificate with an indication against paragliding practice; in this case, the flight card will be extended for the duration specified on the medical certificate.
  • The flight card is to be used by a single pilot and cannot be transferred to another, except under exceptional conditions and with the agreement of Bauges Parapente.
  • Under no circumstances can a flight card be refunded or financially compensated.

Article 13: Protection of Your Personal Data

Bauges Parapente will not sell, rent or communicate information about you to third parties. In case of theft of documents containing information about you, whether on paper or in digital format, Bauges Parapente declines any responsibility for the use that might be made of the data concerning you.

The photos and texts displayed on the website www.bauges-parapente.com are not contractual.

Article 14: Right to Image

Unless the client expressly objects before the start of the activity, the client authorizes Bauges Parapente to use the images (photos and videos) taken during the activity, without limitation, for promotional and commercial purposes. The parents of the minor client grant permission to use the images of the minor client under the same conditions.

However, in the event of a potential disagreement between Bauges Parapente and one of its clients arising from the use of the client’s image, the photo/video will simply be removed from all communication media at the client’s request.

Article 15 : Litige – MÉDIATION DE LA CONSOMMATION

In the event of a disagreement between the client and the website’s author, both parties will aim to resolve it peacefully. The client will submit a complaint by email (contact@bauges-parapente.com) or by registered mail (Thomas BATARD ZA La Madeleine 73340 Lescheraines). In the absence of a response by Bauges Parapente or if the professional does not respond within a reasonable period of one (1) month, as of the Article L.133-4 of the Consumer Code, the client has the option to reach out, free of charge, to the mediator competent on the list of mediators established by the Evaluation and Control Commission for Consumer Mediation, in application of Article L.615-1 of the Consumer Code.
